1. Online contract: object and stipulation
This contract concerns the online sale of movable goods and/or services and is stipulated remotely between Dusty Wheels Racers srls, with registered office in Rome, via Santa Seconda n. 19 - hereinafter referred to as DWR- and a purchaser - hereinafter referred to as Customer-; all of this takes place through a distance selling system organized by DWR which for this purpose exclusively uses the distance communication technology known as the internet. The contracts, therefore, will be concluded directly through access by the Customer to the Officine08 website, corresponding to the addresses www.dustywheelsracers.it and www.dwrshop.it where, following the instructions provided, the Customer will conclude the contract for the purchase of the goods also by telephone or e-mail.
2. Method of purchase
To purchase a product, the Customer must first complete the registration procedure by providing all the personal data requested by DWR, which must be truthful and must be indicated without any omissions.
All the products on the site have a sales price inclusive of VAT; the shipping cost may vary according to the size of the goods, the destination and the quantity of products ordered.
The Customer can pay for the goods ordered through the services indicated online at the time of purchase:

3. Methods and times of delivery
DWR will deliver the purchased products to the Customer via trusted couriers; alternatively, at the unquestionable judgment of DWR,
the purchased products can be delivered directly by a person in charge of the same.
Delivery times vary according to the availability of the goods, which is always expressly indicated for each individual item. Furthermore, delivery times may also vary according to the payment method chosen by the Customer, the size of the package to be sent and the destination to which the goods must be sent. It is specified that the order is processed only after the actual receipt of the payment

The indications on delivery times above are to be considered valid for products in the warehouse, for those not in stock, delivery times start from procurement, the latter products are recognizable because they are marked with the wording "Not Available"
3.1 Cost of Transportation
For products delivered throughout Italy, the cost of transport is 8€ (eight euros), excluding VAT. For deliveries abroad, the shipping costs are calculated based on the country of destination, the weight and the availability of the products.
4. Rights and obligations of the Client
The customer is considered solely responsible for entering their data. As for the data necessary for registration on the site, the Customer is absolutely prohibited from entering false and/or fictitious data.
At the unquestionable request of DWR, the Customer undertakes to deliver copies of their valid identity documents; failure to comply with the aforementioned request authorizes DWR to terminate the contract due to breach by the Customer.
Upon receiving the goods, the Customer must check the condition of the packaging and, if damaged, sign the transport document shown by the courier subject to control, specifying in each case the way in which the packaging is damaged (e.g. puncture, rain, scratches, etc.); failure to comply with this obligation prevents the purchaser from making use of the right of withdrawal.
By signing subject to control , the Customer can request the replacement of the product or a refund. In the event of damaged goods and within 48 hours of receiving the same, the Customer is required to notify DWR first by e-mail or fax, followed by communication by registered letter.
5. Rights and Obligations of DWR
The websites www.dustywheelsracers.it and www.dwrshop.it are owned by the company DUSTY WHEELS RACERS SRLS , with registered office in Rome, Via Santa Seconda 19.
All Trademarks, Logos or other distinctive signs shown on the aforementioned sites are the property of DWR and/or of the various respective Owners. It is expressly forbidden to use the Trademarks, Logos and other distinctive signs by anyone, for any purpose and in any way, including their reproduction on other websites, without the prior written authorization of DWR or of the various legitimate Owners. All contents: texts, images, logos and graphics on the site are protected by copyright; it is therefore forbidden to distribute, transmit, copy, modify, publish the contents of the site for commercial purposes, without the prior consent of the person entitled.
The images of the products published on the site are purely indicative. In the absence of specific indications in the order notes, the lack of conformity of the purchase cannot be complained of.
DWR is not responsible for any fraudulent or illegal use that may be made by third parties of credit cards, checks and other means of payment, when purchasing the products, since it is not, at any time, part of the procedure .
6. Warranties and Assistance
The products sold by DWR are guaranteed directly by the manufacturer for one or two years from the date of purchase. This service is provided directly by the manufacturers of the goods sold, through their own assistance centres.
7. Right of withdrawal
The Customer who intends to withdraw from the contract can exercise his right within the term of 14 days starting from the day on which the Customer or a third party, other than the carrier and designated by the Customer, acquires possession of the goods; this right can only be exercised by consumers, and not by resellers and/or VAT holders. The Customer-consumer can exercise the right of withdrawal by forwarding explicit written communication to DWR to the email address ordini@dustywheelsracers.it or through the contact form ; to respect the withdrawal deadline it is sufficient for the Customer-consumer to send the communication relating to the exercise of the right of withdrawal before the expiry of the withdrawal period.
Withdrawal from this contract entails reimbursement to the Customer-consumer of the cost of the goods paid to DWR, excluding delivery costs and payment commissions. The return by the customer must take place without undue delay and in any case no later than 14 days from the day on which DWR received the notice of withdrawal. These refunds will be made using the same means of payment used by the Customer for the initial transaction, unless otherwise agreed between DWR and the Customer.
All items must reach DWR in the same conditions of sale, unused and completely intact, with the original packaging and any manuals, without any lack.
The costs of the redelivery are borne by the buyer and must be made by means of traceable shipping and safeguarding the integrity of the objects given in return.
Customized or commissioned products are excluded from the scope of this regulation.
8. Termination of the contract and express termination clause
In case of supervening impossibility, DWR reserves the right to terminate the contract stipulated with the Customer by simply notifying the same; in this case the Customer will only be entitled to a refund of any sums already paid. In case of impossibility to perform the contract, the articles are applied. 1463 ff. cc The obligations assumed by the Customer (see point 4), as well as the guarantee of the successful conclusion of the payment that the Customer makes with the means referred to in point 2, as well as all the other obligations envisaged for the Customer, are of an essential nature and the Failure by the Client to fulfill even just one of these obligations will result in the legal termination of the contract pursuant to Article 1456 of the Civil Code, without prejudice to DWR's right to compensation for any damages suffered and pending.
9. Jurisdiction And Jurisdiction
Any dispute relating to the application, execution, interpretation and violation of the purchase contracts stipulated 'online' is governed by Italian law; any dispute between the parties regarding the application, execution, interpretation and violation of this contract will be the exclusive jurisdiction of the Court of Rome.
10. Personal Data Processing
The data controller is the company DUSTY WHEELS RACERS SRLS , with registered office in Rome, Via Santa Seconda 19. The Customer declares to have received the privacy information required by Legislative Decree 196/2003.
DWR reserves the right to modify these general conditions of sale at any time by informing customers
